Website Privacy Policy (UK) for Perfect4U Members

Perfect4U Limited ("Perfect4U") is a company incorporated in Gibraltar and is committed to ensuring that your privacy is protected. The purpose of this statement is to set out how we use personal information that we may obtain about you. By either registering as a user of any services provided by Perfect4U on this website and by using the Perfect4U website generally you agree to this use.


Use of your Personal Information
When you ask us to contact you or you register as a Member and at other times you will be asked to provide certain information, such as your contact details. We will store this data and hold it on computers or otherwise. We will use this data to fulfil our obligations under the Member Agreement with you if you register and to provide you with information about becoming a Member. Some of our services may require further details.


2. We may use information that you provide or that is obtained by us:

(a) to register you with our website and to administer our website services. We may also use aggregate information and statistics for the purpose of monitoring website usage in order to help us to develop the website and our services and may provide such aggregate information to third parties. These statistics will not include information that can be used to identify any individual;1
(b) for assessment and analysis (e.g. market, customer and product analysis) to enable us to review, develop and improve the services which we offer and to enable us to provide you and other customers with relevant information through our marketing programme. We may use your information to make decisions about you using computerised technology, for example automatically selecting products or services which we think will interest you from the information we have. We may keep you informed of such products and services (including special offers, discounts, offers, competitions and so on by any of the following methods:

  • telephone (including automated calls)
  • SMS text message and other electronic messages such as picture messaging

  • fax

3. We may supplement the information that you provide to us with information that we receive from selected third parties whose products and services we believe may be of interest to you. When you register as a Perfect4U Member we will ask you to confirm that you agree to receive information on such products and services.3

 

Fraud Prevention

4. In order to protect our Members and us from fraud and theft, we may pass on information that we obtain from making identity checks and other information in our Membership records, including how you conduct your account, to other Group companies, other retailers and to financial and other organisations (including law enforcement agencies) involved in fraud prevention and detection, to use in the same way.

 

Disclosure of Your Information

5. We may give information about you to the following, who may use it for the same purposes as set out above:

(a) to other companies in the Perfect4U Group of companies;
(b) to employees and contractors of the Perfect4U Group to administer any accounts, products and services provided to you by the Group now or in the future;
(c) Agents who (on our behalf) profile your data so that we may tailor the goods/services we offer to your specific needs;
(d) to other organisations for the administration of prize draws or competitions.
(e) to anyone to whom we transfer or may transfer our rights and duties under our agreement with you;
(f) to other entities and companies outside of the Perfect4U Group acing as sales agents and marketing representatives on behalf of Perfect4Uand to their agents and representatives for the purposes of the administration of marketing commissions payable; and
(g)  if we have a duty to do so or if the law allows us to do so.

We may retain other companies and individuals to perform functions on our behalf. Such third parties may be provided with access to personally identifiable information needed to perform their functions, but they may not use such information for any other purpose. Such third parties may also use the information collected in aggregate form for their internal business purposes, such as generating statistics for marketing materials.

We may collect, store or accumulate certain non personally identifiable information concerning your use of this website, such as information regarding which of our pages are most popular. We may share or transfer such non personally identifiable information with or to our affiliates, partners and licensees.

Please note that our rights to use your personally identifiable information will be based on the privacy policy in effect at the time the information is used.

 1. Because individuals cannot be identified from statistical data, this statement is not strictly required under the Data Protection Act 1998, but is supplied in the interests of completeness and for customer relations purposes.

 2. Under the UK rules on unsolicited marketing e mails you or third parties to whom you have provided your customers’ details, cannot send such messages unless they have the recipient’s prior consent to do so.
This strict “opt-in” rule is relaxed if three exemption criteria are satisfied.
These three exemption criteria are as follows:
1. The recipient’s email address was collected “in the course of a sale or negotiations for a sale”
2. The sender only sends promotional messages relating to their “similar products and services” AND
3. When the address was collected, the recipient was given the opportunity to opt out (free of charge except for the cost of transmission) which they didn’t take. The opportunity to opt out must be given with every subsequent message. Whether you have an opt out or opt in box for other marketing e mails will depend on the circumstances when you accept the details of the Member. It seems to us that in respect of Members the best way is to include an opt in on the application form including a specific consent so that the emails are not unsolicited.
